Terms of Use

Last updated: 1 June 2026

These Terms of Use govern your access to and use of the ACA Integrated Management System (AIMS) operated by the Anti-Counterfeit Authority. By registering or using AIMS you agree to these terms.

This is sample placeholder content for the AIMS prototype and is not the Authority's official policy or legal advice.

1. Acceptance of terms

By creating an account, submitting an application or otherwise using AIMS, you confirm that you have read, understood and agree to be bound by these Terms of Use and the Privacy Policy.

2. Eligibility & accounts

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Partner agency and internal staff accounts are provisioned by ACA and may not be self-registered.

3. Use of the portal

AIMS is provided for legitimate IPR recordation, permit, agent-admission, search and verification purposes. You agree to use the portal lawfully and not to interfere with its operation or security.

4. Applications, fees & payments

Applicable fees are displayed before submission and are paid through the e-Citizen gateway. Unless expressly stated, fees are non-refundable once an application has been submitted or a service rendered. ACA may update the fee schedule from time to time.

5. Accuracy of information

You warrant that all information and documents you submit are true, complete and not misleading, and that you are entitled to submit them. Providing false information may result in rejection, account suspension or legal action.

6. Intellectual property

The AIMS platform, its content and branding are owned by or licensed to ACA. Recording an IPR through AIMS does not transfer ownership of that right to ACA. You retain rights in the materials you submit, granting ACA a licence to process them for the services.

7. Prohibited conduct

You must not:

  • Attempt to gain unauthorised access to any part of AIMS or other users' data.
  • Upload malicious code or content that infringes the rights of others.
  • Misrepresent your identity or authority to act on behalf of a rights holder.
  • Use automated means to extract data from the registry except via approved interfaces.

8. Service availability & disclaimers

AIMS is provided on an “as available” basis. While we target high availability, we do not warrant uninterrupted or error-free operation, and may suspend the service for maintenance.

9. Limitation of liability

To the extent permitted by law, ACA is not liable for indirect or consequential loss arising from use of AIMS. Nothing in these terms limits liability that cannot be excluded under Kenyan law.

10. Termination

We may suspend or terminate access where these terms are breached or where required by law. You may stop using AIMS at any time; statutory record-keeping obligations will continue to apply to submitted applications.

11. Governing law

These terms are governed by the laws of Kenya. Disputes are subject to the exclusive jurisdiction of the Kenyan courts.
